Terms of Service

These Terms of Service ("Terms") govern your use of the DocPat mobile application, website, and all related services (together, the "Service") operated by DocPat ("we", "us", "our"). By downloading the app, creating an account, or using the Service in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What DocPat Is — and Is Not

DocPat is a secure personal health record wallet. It lets you store encrypted copies of your medical documents, give each one a tamper-proof blockchain seal, and share them with healthcare providers through PIN-protected QR codes.

2. Eligibility

• You must be at least 13 years old (or the minimum age required by law in your country) to use the Service.
• You must provide a valid phone number for account registration.
• By using the Service, you represent that all information you provide is accurate and that you have the legal capacity to enter into these Terms.
• If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Your Account

• You are responsible for maintaining the security of your account, sign-in credentials, and recovery PIN.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at docpat.contact@gmail.com if you suspect any unauthorized access to your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans & Pricing

DocPat offers the following subscription plans. All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

What is always free on every plan: Sharing via QR codes, document viewing, blockchain seals, OTP login, and key recovery are available at no charge on all plans including Free. Only storage capacity is determined by your plan.

Extra storage add-on: Pro users may purchase additional storage at ₹35/GB/month. Clinic users may purchase additional storage at ₹25/GB/month. Add-ons are billed in the same cycle as your subscription.

5. Billing & Payment

• Paid subscriptions are processed through Google Play In-App Billing. By subscribing, you also agree to Google Play's Terms of Service.
• Payment is charged to the Google account linked to your device at the time of purchase confirmation.
• All transactions are handled securely by Google. DocPat does not store your payment card details.
• Subscription fees are charged in advance at the start of each billing period (monthly or annual).
• Prices are subject to applicable taxes as determined by your region.

6. Auto-Renewal

• You can view your renewal date at any time in your Google Play account under Subscriptions.
• We may send renewal reminder notifications within the app or via email before your billing date.
• If Google is unable to charge your payment method, your subscription may be suspended or downgraded to the Free plan until payment is resolved.

7. Cancellation

• You may cancel your subscription at any time through Google Play → My Subscriptions → DocPat → Cancel.
• Cancellation takes effect at the end of the current billing period. You will retain access to your paid plan until that date.
• After cancellation, your account is automatically downgraded to the Free plan (100 MB). If your stored data exceeds the Free plan limit, you will not be able to upload new documents until you either re-subscribe or delete enough data to stay within the limit. Your existing documents remain accessible.
• Cancelling does not delete your account or your documents.

8. Refunds

• Google Play provides a 48-hour refund window for new subscriptions. You may request a refund directly through Google Play within this window.
• For refund requests outside the Google Play window, contact us at docpat.contact@gmail.com with your order ID and reason. We review these on a case-by-case basis.
• Refunds for annual plans that have been used for more than 30 days are generally not available, except where required by applicable law.
• DocPat does not issue refunds for partial months or partial years.
• Refunds are not available for the Free plan (as no payment is made).

9. Price Changes

We may change subscription prices from time to time. We will notify you of any price change via email or in-app notification at least 30 days in advance. Price changes take effect at your next renewal. If you do not cancel before the renewal date, you consent to the new price. Where required by law, we will seek your explicit consent before applying price increases.

10. Free Plan & Beta Period

DocPat is currently available as a beta release. During this period, access to the Free plan is provided at no charge and without a specific end date. We reserve the right to modify Free plan limits or introduce new restrictions when the product moves out of beta, with at least 30 days' notice to existing users. Paid plan features and pricing are described in Section 4 above and are effective upon subscription.

11. Keys, PINs & Recovery — Your Responsibility

DocPat's privacy-first architecture means only you hold the decryption keys to your documents. Keys are stored in your device's built-in secure hardware and never leave your device in usable form. The optional key backup is protected by a recovery PIN that only you know.

12. Sharing & Access Control

• You decide what to share, with whom, and for how long. Shares can be revoked by you at any time.
• When you approve a recipient, you grant them temporary, view-only access to the selected documents.
• You must only share documents you are legally entitled to share.
• If someone shares documents with you through DocPat, you agree to access them only as authorized, only for the intended purpose, and not to attempt to copy, screenshot, or redistribute them.

13. Acceptable Use

You agree not to:

• Upload content that is unlawful, infringing, or that you do not have the right to store or share;
• Use the Service for any purpose other than storing and managing legitimate personal or family health records;
• Attempt to bypass, defeat, or interfere with any security control, lock, or authentication mechanism in the Service;
• Probe, scan, flood, or otherwise disrupt the Service, its infrastructure, or other users;
• Reverse engineer, decompile, or disassemble any part of the Service (except as permitted by applicable law);
• Create multiple accounts to circumvent plan limits;
• Impersonate any person or misrepresent your authority to act on someone else's behalf;
• Use the Service in any way that violates applicable law or regulation.

Violation of these rules may result in immediate suspension or termination of your account without refund.

14. Blockchain Seal Disclosures

• Each document seal is recorded on a public, permanent blockchain (Polygon). The seal contains only a cryptographic reference and a timestamp — no personal data, no document content, and no medical information.
• Seals are permanent and cannot be edited or deleted by anyone, including DocPat. Deleting a document in the app deactivates it in your wallet but does not remove the seal from the blockchain.
• Blockchain confirmation times and network availability are operated by independent third parties outside our control.

15. Intellectual Property

The Service, including its software, design, interface, and brand assets, is owned by DocPat and protected by applicable intellectual property law. You retain full ownership of all documents you upload. You grant DocPat only the limited technical licence necessary to store and transmit the encrypted form of those documents as needed to operate the Service. We make no claim of ownership over your health data.

16. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that encrypted content will be recoverable if you lose your keys and recovery PIN.

17. Limitation of Liability

To the maximum extent permitted by law, DocPat and its team members shall not be liable for any indirect, incidental, special, consequential, or exemplary damages — including loss of data, loss of document access resulting from lost keys or PINs, or damages arising from unauthorized sharing by recipients you approved. Our total aggregate liability to you for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim (or ₹1,000 if you have paid nothing).

18. Indemnification

You agree to defend, indemnify, and hold DocPat harmless from any claims, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third-party rights.

19. Account Termination

You may stop using the Service and request account deletion at any time by contacting docpat.contact@gmail.com with "Account Deletion" in the subject line. We will process deletion requests within 30 days. Deletion does not entitle you to a refund of any subscription fees already paid. We may also terminate or suspend your account immediately if you breach these Terms, create a security risk to others, or if the Service is discontinued, with reasonable notice where practicable.

20. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By agreeing to these Terms, you acknowledge that you have read and understood the Privacy Policy.

21. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to its conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of India. If you are a consumer, you may also have rights under the consumer protection laws of your place of residence that cannot be waived by this clause.

22. Changes to These Terms

We may update these Terms as the Service evolves. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Continued use of the Service after the effective date of a change constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service before they take effect.
